Ireland West Transport Management
1. Services
Ireland West Transport Management provides transport compliance support, advisory services, tachograph analysis, and external Transport Manager services in accordance with Irish and EU regulations.
2. Nature of Services
All services are advisory in nature. Ireland West Transport Management does not assume operational control of vehicles, drivers, or transport activities.
3. Client Responsibility
The Operator Licence holder remains fully responsible at all times for:
- Vehicle operation and roadworthiness
- Driver conduct and compliance
- Maintenance and safety systems
- Compliance with all applicable laws and regulations
4. Accuracy of Information
All services are based on information and documentation provided by the client. Ireland West Transport Management accepts no liability for errors, omissions, or inaccuracies in client-provided data.
5. Compliance Disclaimer
While every effort is made to support compliance, Ireland West Transport Management does not guarantee regulatory compliance or the prevention of enforcement action.
6. Limitation of Liability
Liability is strictly limited to the total fees paid for services or the level of Professional Indemnity Insurance held, whichever is lower.
Ireland West Transport Management shall not be liable for any indirect, consequential, or financial losses.
7. Tachograph Reporting Disclaimer
Tachograph reports and analysis are based solely on available data and may not reflect all driver activities or undeclared work.
8. External Transport Manager Role
Where acting as External Transport Manager, responsibilities are carried out in accordance with EU Regulation 1071/2009. Legal responsibility remains with the Operator Licence holder.
9. Payment Terms
Invoices are payable within 7–14 days unless otherwise agreed. Services may be suspended in the event of non-payment.
10. Termination
Either party may terminate services with 30 days' written notice. Immediate termination may occur where compliance or legal risks arise.
11. Governing Law
These terms are governed by the laws of Ireland.
